My H-1B extension is currently pending, and my original H-1B has already expired. I am continuing to work under the 240-day automatic extension rule. We expect the extension to be approved within the next two months.
My wife was recently laid off and is currently in the 60-day grace period on her H-1B. Can she file a change of status (COS) to H-4 while my H1B is pending? If so, what would be the validity end date on the H-4 approval notice? Do we need to send another COS request after H1B approved?
