Hi all,

I've been working outside the states for over a year and the company I'm working for is now applying for L1A visa for me so that I can work in the states headquarter. I know that L1A visa holder can apply for Green Card more easily than H1b. But when can I start filing for Greencard process? Does the company have to file for me or I can hire an attorney to do it? Additionally, how long does the process take from the point I file for Greencard to the point I finally get it?

您好，如果您想通过L1A申请EB1C跨国高管绿卡，需要您美国的公司实际运营一年以上，您雇主就可以帮您申请EB1C绿卡。之前EB1类型的绿卡是没有排期的，可以同时递交绿卡申请和移民资格申请，一般审理时间在6-9个月左右，但是8月暂时出现了排期，之后有可能会再次取消排期，还需要看移民局的安排。律师是代理您的雇主为您递交绿卡申请，如果您的雇主同意，您也可以找到律师为雇主代理。

Thank you Carly. I have another question. I'll be working under L1A visa starting this September. But I'm planning on having a full time MBA starting August 2017, meaning that my visa type will be student visa during my MBA study. After I finish MBA can I return to my current company and work under L1A and am I still eligible to apply for EB1C greencard?

Hi Ying,

Your company may file the EB1C green card petition for you anytime, provided that at the time of filing the company has been in existence in the US for at least 1 year. You cannot file the petition by yourself.

The processing time depends on the availability of the visa numbers.
