租房条款 landlord对解决噪音的responsibility

您好,

四月搬进apartment由于该apartment 每晚发出极大的噪音(估计是water hammer)然而management 公司查不出原因解决。。同意terminate lease或换apartment..我选择换到另一间apartment.. 然后landlord公司重新给了一份合同,偷偷加了一份MIXED USE ADDENDUM 。。

PURPOSE OF ADDENDUM. The purpose of this Addendum is to provide you with notice that the apartment is located in a mixed-use living environment. The area surrounding the apartment contains both residences and commercial businesses. These commercial entities will produce certain noises, sounds, and odors up to twenty- four (24) hours a day. 

  1. You have chosen to reside at the apartment despite any inconveniences such as those disclosed herein or any other inconvenience, which may be associated with living in a mixed-use environment. You further agree: You are voluntarily assuming the risks of inconvenience and nuisance related to residing in an apartment located in a mixed-use area. 

 

声称自己的apartment是mixed-use building...现在签了这份协议landlord就可以不对任何邻居以及其他噪音负责。。我也不能因为噪音侵犯了我quiet enjoyment 的权利而对landlord complain

您好,这种情况下建议您和房东进行协商,如果您签署了这份租房合同,表示您同意了以上的条款,是具有法律效力的。如果您想要维护自己的权益,可以和房东协商更改条款。
