Can I ask you a question about H4 EAD after Greencard I140 approval? I submitted my Greencard application this June. I would like to send the H4 and H4 EAD application for my spouse after I receive the I140 approval. Here is the information for my husband:
Right now he is F1 (no opt no cpt). He started this F1 from 07/06/2020. He is going to apply F1 CPT later this month, which is after having attended half-semester courses major in MBA. Before this MBA, he already got a PhD in economics and completed his first OPT. He will maintain his F1 CPT status until he changes his status to H4.
Will USCIS deny the H4 application or H4 change of status in this case? How likely is that? Have you dealt with similar cases before?
