is my case violating the 90-day rule?

公开 1 回答
I married to my boyfriend who has a green card in Las Vegas last year while I was holding an F-1 visa. Up until now, we've filed Form I-130 and this July we are going to file Form I-485. But now I know we got married within 90 days since my last entering with F1 visa and filed the I-130.

is my situation violating the 90 Day Rule?

Base on the information you've provided, I don't believe you have violated the 90-day rule regarding I-485. Basically, you cannot apply for I-485 within 90 days after entering the states with a non-immigrant visa.
