你好 我OPT16年2月过期 利用Grace Period申请了H1b 但是没有抽中。 刚刚收到了拒信 notice date是6月16日，在6月16日后还有一个60天的Grace Period， 请问一下我可以利用这60天境内转成F2吗。 刚刚和男友结婚，男朋友也是F1 OPT期间。 被拒的可能性大吗？谢谢！

您好，想跟您确认一下您的情况，您是没有抽中，收到了退回包裹？还是抽中了审理没有通过？

如果您是没有抽中，收到退回包裹，且您在递交材料后没有向学校申请Cap-Gap延期到6月1日，那么您的SEVIS可能已经终止了，那么您需要尽快出境，再从国内签F2签证入境。F1身份是否已经被终止可以向学校的国际学生办公室确认一下。

如果您是审理没有通过，那么收到拒信后您是有60天的grace period的，您可以在grace period期间向移民局递交身份转换的申请，只要您的F1身份还有效，您配偶的F1身份有效，且你们的婚姻关系真实，那么申请转成F2是没有什么问题的。

可是我在uscis上看到 没有被抽中的case也是有60天的Grace Period的：Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension of status will continue through September 30. If the student’s H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States.

您好，因为您的OPT2月已经过期，您必须要拿着您的tracking number去学校申请Cap-Gap延期到6月1日。如果没有申请，那么学校这边会在您grace period到期后终止您的SEVIS。这种情况下也就没有Cap-Gap延期后的grace period了，建议您和学校先进行确认。
